Industry News | Ministry of Natural Resources, Ministry of Housing and Urban Rural Development issues notice on measures to further support urban renewal actions







Each province, autonomous region, municipality directly under the central government, and the State Council shall approve the overall planning of national land and space. The natural resources department and housing and urban-rural development department of the Xinjiang Production and Construction Corps shall:


In order to implement the requirements of the "Opinions of the Central Committee of the Communist Party of China and the State Council on Promoting High quality Urban Development" and the "Opinions of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Continuously Promoting Urban Renewal Action", combined with the practical needs of urban renewal in various regions, and based on the existing planning and land policy guidelines that support urban renewal, the measures to further support urban renewal action are hereby notified as follows.


1、 Enhance the adaptability of detailed planning


(1) Based on the overall national spatial planning and urban renewal special planning, the urban renewal goals and work priorities are determined, and combined with the needs of the "15th Five Year Plan" urban renewal action, the detailed planning of the proposed urban renewal areas is evaluated and optimized. According to legal procedures and relevant requirements, technical revisions, optimization adjustments, and other methods can be adopted to optimize the original detailed plan, and it can be included in the "One Map" of national spatial planning for implementation and supervision. We can combine the improvement of public participation and supervision methods to develop simplified and detailed planning modification procedures.


(2) Based on the development needs of new industries and formats, a positive list and control requirements for mixed land development and spatial composite utilization can be formulated, which shall be approved by the detailed planning and approval authority; In the implementation of urban renewal projects, those that meet the positive list are considered to comply with detailed planning.


(3) On the premise of ensuring public safety and interests, not affecting the legitimate rights and interests of surrounding stakeholders, not changing the main structure of the building, not damaging the historical style and landscape environment, and meeting the needs of practical land, a planning permit exemption list can be formulated for micro renewal projects such as improving community public service (municipal) facilities (including community vehicle parking areas and charging facilities), enhancing community public space service functions (including installing elevators, barrier free facilities, community green spaces, fitness trails, etc.).


2、 Optimize transitional support policies


(4) Those who utilize existing land and real estate resources to develop industries and sectors supported by the state can enjoy a transition period policy that does not change the land use subject and planning conditions for a certain period of time, with the transition period generally not exceeding 5 years. At the end of the transition period, if it meets the requirements of industrial development direction and performance supervision, the land use procedures shall be handled according to the new use as agreed in accordance with the law; Those who do not comply shall withdraw from the transitional support policy as agreed and maintain their original land use. For those who have completed the procedures for compensated land use at the end of the transition period, leasing or agreement transfer can be adopted.


3、 Promote the temporary utilization of existing land and space


(5) Temporary utilization rules for idle construction land (excluding temporary land) can be formulated on the premise of safeguarding the legitimate rights and interests of relevant parties, ensuring safety, and not affecting the implementation of long-term planning. The rules should specify the deadline and restoration measures upon expiration, and be included in the "one map" for implementation and supervision.


(6) On the basis of coordinating with relevant departments, temporary utilization control rules for existing buildings (structures) can be formulated without increasing the plot ratio and height. Positive list management can be implemented for the use, and those included in the positive list do not need to apply for planning permits.


4、 Encourage the overall operation of resource asset portfolio supply


(7) We will pay more attention to the development of distinctive features, actively carry out investigations and revitalization of natural, landscape, and cultural heritage resources in the region, and optimize the functional structure and use control in conjunction with national spatial planning. We will establish and improve a mechanism for the combination supply, overall operation, and reasonable allocation of multiple types of resource assets within a specific national spatial scope, forming new driving forces and advantages to promote urban renewal actions.


5、 Innovative real estate registration services


(8) According to the provisions of the property rights adjustment agreement, real estate units can be pre prepared to handle advance notice registration for the original ownership, mortgage and other rights holders, ensuring the continuity of real estate rights in the implementation of updates.


(9) For self updating projects of old houses, real estate registration services can be provided through direct household registration for the first time. For those involving the collection of property rights through transfer, exchange, etc., different registration types can be flexibly used to provide services.


(10) For land and buildings that are collected, stored, and supplied together, simplified application materials can be explored to provide registration services based on the property rights, boundaries, area, purpose, and other information specified in the paid use contract or allocation decision, while ensuring the safety bottom line.


6、 Properly handle historical legacy issues


(11) According to the principles of law and regulations, respect for history, fairness and justice, inclusiveness and prudence, based on their causes and taking into account the continuity of land management policies, and on the premise of safeguarding the interests of innocent parties, we will properly handle historical legacy issues. For construction land formed in history without legal land use procedures, based on the results of the national land survey, different periods of occurrence shall be classified according to laws and regulations, clear identification standards and disposal policies shall be made, and properly handled. It shall be included in the "one map" for supervision to ensure a clear bottom line, closed operation, strict adherence to the bottom line, and risk control.


The Ministry of Natural Resources and the Ministry of Housing and Urban Rural Development will strengthen work guidance and policy coordination, conduct timely business training and exchanges, and summarize replicable and promotable experience and practices. Natural resources, housing and urban-rural development departments at all levels should strengthen communication and cooperation, optimize and refine relevant measures based on actual conditions, study and solve difficult problems, timely summarize practical experience, and report important matters in a timely manner.
